At a glance: These Terms explain online ordering, payment, delivery, collection, cancellations, returns, warranties and customer accounts. They do not remove any rights that South African law gives a consumer.

1. Who We Are

By using the website, creating an account or placing an order, you agree to these Terms. If you do not agree, do not place an order.

2. Scope of These Terms

2.1 These Terms apply to products purchased through the Visual Works website, including locally manufactured products, AV accessories, consumables, 3D-printing products, robotics products and other items listed in the shop.

2.2 A quotation, installation, custom solution, tender, service agreement or commercial project may also be subject to the Visual Works General Conditions of Sale and Service and the accepted quotation.

2.3 If a specific product page or quotation contains special terms, those special terms apply to that product or project to the extent of any conflict.

3. Product Information and Availability

3.1 We aim to describe products accurately, but colours, scale and appearance may vary by screen and manufacturer.

3.2 Dimensions, compatibility, performance and included items are based on the information available when published. Contact us before ordering where compatibility is important.

3.3 Stock indicators are not a guarantee. An item may become unavailable after an order is placed.

3.4 We may correct obvious errors in descriptions, images, specifications or prices. If a correction materially affects your order, we will contact you before fulfilment, and you may accept the correction or cancel the affected item.

4. Prices and VAT

4.1 Prices are displayed in South African rand.

4.2 Where stated as “incl. VAT”, the displayed price includes VAT at the applicable rate.

4.3 Delivery, collection, installation, insurance or other charges are shown separately before you place the order where applicable.

4.4 Promotions, coupons and prices may be changed or withdrawn before an order is accepted.

5. Placing an Order

5.1 You must provide accurate contact, billing and delivery information.

5.2 The checkout confirmation and automated email acknowledge receipt of your order. Final acceptance occurs when payment is confirmed, and we accept the order for fulfilment.

5.3 We may decline or cancel an order where payment fails, stock is unavailable, the information supplied is inaccurate, fraud is suspected, a pricing error is obvious, or fulfilment would be unlawful or impractical.

5.4 If we cancel after receiving payment, we will refund the amount received for the cancelled item using the original payment method where reasonably possible.

6. Customer Accounts

6.1 You may check out as a guest or create an account where the website allows it.

6.2 You are responsible for keeping your login details secure and for activity under your account.

6.3 Tell us promptly if you suspect unauthorised access.

6.4 We may suspend an account used fraudulently, unlawfully or in a way that threatens the website or other users.

7. Online Payment

7.1 Online payments are processed through PayFast or another payment provider shown at checkout.

7.2 We do not receive or store your complete card details.

7.3 Payment is subject to the payment provider’s terms, verification and security controls.

7.4 An order is not paid until Visual Works receives successful payment confirmation.

7.5 We may request reasonable identity or transaction verification to protect customers and prevent fraud.

8. Delivery

8.1 Available delivery options and charges are displayed after you enter a qualifying delivery address.

8.2 Delivery periods are estimates in Business Days and begin after payment confirmation and stock allocation.

8.3 You must provide a complete and correct physical address, postcode, province, telephone number and authorised recipient.

8.4 We may charge reasonable redelivery or storage costs where delivery fails because the address is wrong, access is restricted or nobody is available to receive the parcel.

8.5 Inspect the package on receipt. Record visible damage or shortages with the courier and notify us promptly with photographs and the order number.

8.6 We are not responsible for delay caused by events outside our reasonable control, but we will keep you informed and take reasonable steps to complete delivery.

9. Collection from Visual Works

9.1 Where free collection is offered, wait for confirmation that the order is ready before travelling to collect.

9.2 The person collecting may be required to provide the order number, identification and written authority from the purchaser.

9.3 Risk passes when the order is handed to the authorised collector.

10. Installation and Compatibility

10.1 Unless expressly included, online product prices do not include installation.

10.2 A product described as universal may still require a compatibility check for the specific projector, display, ceiling, structure or environment.

10.3 You are responsible for ensuring the installation surface, electrical supply and site conditions are suitable unless Visual Works has been contracted to inspect or install.

10.4 Improper self-installation, unauthorised modification or use outside the product specification may affect warranty remedies to the extent permitted by law.

11. Cancelling an Online Order

11.1 Contact us as soon as possible if you wish to cancel.

11.2 A standard item that has not yet been dispatched can normally be cancelled and refunded.

11.3 Where the Electronic Communications and Transactions Act provides a cooling-off right for a qualifying electronic transaction, you may exercise that right within the applicable statutory period and subject to the statutory exclusions and return-cost rules.

11.4 Cooling-off or change-of-mind rights may not apply to goods made to your specifications, clearly personalised goods, software that has been unsealed or activated, services that began with your consent, or other excluded transactions.

11.5 Custom-manufactured, specially configured, imported or special-order goods may not be cancellable once production or procurement begins, except where the law gives you a non-waivable right.

12. Returns and Refunds

12.1 Contact admin@visualworks.co.za with your order number before returning an item.

12.2 We may issue return instructions or a return authorisation number. Unauthorised returns may be delayed or refused where lawful.

12.3 For a lawful change-of-mind return, the product must be complete, safely packaged and in a condition that permits lawful inspection and resale, subject to any statutory right to inspect.

12.4 You may be responsible for return delivery costs for a change-of-mind cancellation where the law permits.

12.5 Where we supplied the wrong item, or the item was defective or damaged when supplied, Visual Works will arrange an appropriate remedy in accordance with applicable law.

12.6 Refunds are made to the original payment method where reasonably possible after the return and entitlement are verified. Bank and payment-provider processing times are outside our control.

12.7 A reasonable deduction may be made for diminished value caused by use or handling beyond what is reasonably necessary to inspect the product, where lawful.

13. Defective Goods and Warranty

13.1 Products are supplied with the statutory rights and implied warranty of quality provided by applicable South African law.

13.2 Where the Consumer Protection Act applies, a consumer may have the right within six months after delivery to return defective, unsafe or unsuitable goods and choose a lawful repair, replacement or refund remedy.

13.3 Manufacturer warranties are additional and do not replace statutory rights.

13.4 Warranty does not ordinarily cover misuse, abuse, accidental damage, lightning, power surges, water, unauthorised repair, improper installation, customer modification, unsuitable infrastructure, fair wear and tear or consumables, unless the law provides otherwise.

13.5 We may inspect or test the product to determine the cause and appropriate remedy.

14. Software, Digital Products and Licences

14.1 Software and subscriptions are subject to the publisher’s licence terms.

14.2 Activation keys, opened software and activated subscriptions may not be returnable after supply, except where defective or where a statutory right applies.

14.3 You are responsible for confirming device, operating-system, network and licence compatibility before purchase.

15. Privacy and Communications

15.1 We process personal information as described in our Privacy Policy at visualworks.co.za/privacy-policy/.

15.2 Order, account, payment, delivery and security communications are transactional and may be sent where necessary to perform the contract or protect the service.

15.3 Marketing communications are handled separately and may be opted out of as described in the Privacy Policy.

16. Website Use and Intellectual Property

16.1 Website content, branding, product copy, photographs, graphics, drawings and downloads belong to Visual Works or the relevant rights holder.

16.2 You may use the website for lawful personal or business purchasing. You may not scrape, copy, reverse engineer, disrupt or misuse the website.

16.3 Product names and third-party trademarks remain the property of their respective owners.

17. Liability

17.1 Nothing in these Terms excludes or limits a right, remedy or liability that cannot lawfully be excluded or limited.

17.2 Subject to clause 17.1, Visual Works is not liable for indirect or consequential loss, including loss of profit, data, business, opportunity or reputation.

17.3 Subject to clause 17.1, our aggregate liability relating to an online order is limited to the amount paid for the affected product or service.

17.4 You must take reasonable steps to minimise loss and protect data and equipment.

18. Complaints and Disputes

18.1 Send complaints to admin@visualworks.co.za with the order number, facts and requested outcome.

18.2 We will attempt to resolve complaints in good faith.

18.3 A consumer may also use any competent consumer commission, ombud, tribunal or court available under South African law.

18.4 These Terms are governed by South African law.

19. Changes to These Terms

19.1 We may update these Terms. The version published when you place an order applies to that order unless a change is required by law or agreed with you.
